Texas judge denies new trial to man with IQ of 47

A judge in Lamar County, Texas, yesterday turned aside an effort to get a new trial for a man with an IQ of 47, leaving in place a 100-year prison sentence.
Advocates said that 18-year-old Aaron Hart, who pleaded guilty to molesting a 6-year-old boy, had not received effective legal assistance because his trial attorney had not presented testimony about Hart’s mental functioning or his ability to understand the charges against him.
Hart will remain in jail pending the outcome of an appeal likely to be heard in the fall. Hart’s parents say he has been raped repeatedly by other inmates since he was first arrested last September.

This is so sad. What as his lawyer’s problem that he didn’t even bring up his issues?
