Wisconsin high court allows taped evidence in abuse case

The Wisconsin Supreme Court has ruled that a tape recording of a school bus driver threatening to beat a boy with Down syndrome can be used as evidence in a child abuse case.
The ruling is a defeat for former Milwaukee bus driver Brian Duchow.
A recorder placed in the boy’s backpack by his parents picked up threatening statements made by Duchow. The boy’s parents turned the recording over to police, and Duchow was convicted of child abuse.
… According to court records, the tape recorded Duchow saying, “Stop before I beat the living hell out of you,” and several other remarks indicated violence; there was also a sound that indicated that the boy had been slapped.
