Feds: Nebraska institution violates rights of residents

The Justice Department has concluded that conditions at the Beatrice State Developmental Center violate its residents’ constitutional and legal rights.
The conclusions were part of a report released Monday that detailed the findings from the latest investigation of the troubled institution for people who are mentally retarded or have other developmental disabilities.
The report came out the same day that state officials announced a five-point plan to address the center’s problems.
… The report cited many of the same problems recently cited by inspectors for the federal Centers for Medicare and Medicaid Services and by Nebraska Advocacy Services. They include numerous unexplained injuries to residents and examples of abuse and neglect by employees.The Justice Department report also said the state has not done enough to ensure that residents can live in the most integrated setting possible, as required by the Americans With Disabilities Act and by the Bush administration’s New Freedom Initiative.
